Terms and conditions for photography workshops and photo tours

1. Trish Punch Photography is not responsible for any other costs which workshop clients may have incurred including but not limited to travel, car rental, insurance, photographic purchases and/or rentals.

2. Trish Punch Photography accepts no liability for death, illness or injury or loss or damage to photo equipment or personal belongings during the course of the workshop or in transit thereto. I can accept no responsibility for losses or additional expenses due to delay or changes in the services to be provided. I reserve the right to change our arrangements should conditions necessitate, or to cancel any aspect of the workshop due to exceptional circumstances. In the event that I deem it necessary to cancel the workshop, I will provide a full refund, which the clients acknowledge as full and final settlement. In the event of a workshop cancellation by Trish Punch Photography, liability of Trish Punch Photography to clients shall be limited to the total value of the workshop. Neither party shall be liable for indirect or consequential loss.

3. By joining any workshops offered by Trish Punch Photography, clients acknowledge that they are aware of risks and are physically capable of safely taking part in the workshop. Further they release Trish Punch Photography from any liability by signing a waiver of liability. Trish Punch Photography will assume no liability for injury, illness or loss of personal property or expenses associated with participation in a workshop.

General terms and conditions applying to all tours and workshops

1.1 By registering for a photo tour or photography workshop with Trish Punch Photography, you agree to the following terms and conditions.

Contract

2.1 Your workshop or tour is registered and there is a contract between you and Trish Punch Photography once a full payment is made for a particular package and date. I will not be liable for default (breach of contract) for circumstances beyond my control, such as poor weather, non‐performance of environmental conditions, travel delays, or other similar factors.

Booking acceptance

3.1 Full payment is required at the time of booking. The receipt of full payment does not imply acceptance of a booking. If paying by PayPal, the PayPal generated receipt does NOT imply acceptance of a booking. I will confirm my acceptance of your booking by email and it is at the time that I send out the confirmation that a contract comes into existence between us. I reserve the right to refuse any booking without giving a reason. It is a condition of your booking being accepted that each client sign my waiver of liability, a copy of which will be forwarded to you on booking and which must be presented to me at the commencement of your tour. Failure to sign a waiver will result in the client’s booking being treated as having been cancelled by you and I reserve the right to impose the cancellation fees described in this agreement.

Cancellation Policy

4.1 In the event that I deem it necessary to cancel the workshop I will provide a full refund which the client(s) acknowledges as full and final settlement. In the event of a workshop cancellation, airline tickets, car rentals and hotel
reservations associated with participation in this workshop will not be refunded.

4.2 Cancellation of a client’s booking must be notified in writing to Trish Punch Photography. Cancellation charges are calculated on the day when written notification is received by Trish Punch Photography. If you need to cancel up to two weeks prior to your workshop, then a 50% refund will be issued. And if you cancel less than two weeks before the workshop start date, you will receive a 25% refund. If you cancel less than one week beforehand, you will receive no refund. All cancellations must be made in writing, emails are acceptable. The date on which the letter or email is received by me, will determine the rates of cancellation charges applicable. In the case of a cancellation from my end, a full refund will be given.

4.3 Once the tour has started, no refunds will be made under any circumstances.

4.4 If the reason for the client’s cancellation is covered by the client’s insurance policy, the client may be able to make a claim under that policy, this is entirely a matter between the client and their insurer.

5.1 Any notices regarding this agreement must be submitted in writing to Trish Punch Photography at Monees, Douglas, Cork, Ireland or via email to trishpunch@gmail.com

Insurance
6.1 You are advised to acquire your own travel insurance and photo equipment insurance. I am not responsible for any damage that your photo gear may incur during any photo tour or workshop.

• Trish Punch Photography strongly recommends that the client purchases comprehensive travel insurance cover for cancellation, medical expenses, personal accident, personal luggage, money and public liability before you travel. The client should ensure that any activities undertaken by the client during the tour are covered by their insurance, in this regard, please note that certain activities may require specific insurance and it is a matter for the client to ascertain the position with their insurer before partaking in any activity. Trish Punch Photography reserves the right to refuse admission to a passenger unless the client has arranged appropriate insurance. Trish Punch Photography accepts no responsibility for loss or personal damage to personal belongings or liability for personal injury/death.

Risk and Liability Limitation

7.1 By booking a tour or workshop, you understand and acknowledge that you may visit a variety of locations during a Trish Punch Photography tour or workshop. Trish Punch Photography aims to provide every client a safe, educational, and enjoyable experience.

By signing a waiver of liability, you certify that you are physically fit and capable of participating in outdoor photography exercises in field locations, have taken personal responsibility to ensure that you have the proper gear to protect from the elements while on location, and are fully and completely aware of any associated risks created by field locations and weather.

I assume no liability for any act, error, omission, injury, loss, delay, mishap, or damage to persons or property arising from any cause during the course of a tour or workshop or in transit thereto. I can accept no responsibility for losses or additional expenses due to delay or changes in the services to be provided.

Meeting times, meeting places and itinerary are subject to changes dictated by the weather, the road conditions and other variables that are part of doing landscape photography. You are responsible for being at the meeting place at the designated time and have your photographic equipment with you.

Trish Punch Photography will assume no liability for injury, illness, or loss of personal property or expenses thereof associated with workshop participation.

You also acknowledge that Trish Punch has the right to refuse service to anyone at any time and that tour and workshop policies are subject to change at any time.

Jurisdiction. If any dispute shall arise from any Trish Punch Photography tour or workshop, it may only be resolved in the jurisdiction of the Irish courts.
The contract and all matters arising in respect hereof shall be subject to Irish law and the jurisdiction of the Irish Courts.

Entire Agreement.

These terms and conditions together with my invoice and waiver of liability set out the whole of our agreement relating to the supply of goods and services to you by me. By making a booking, you are agreeing to accept all of the above conditions. Any person making a booking does so on behalf of all the individuals included in it, so that all are bound by the booking conditions.
